Attorney General Cameron Challenges Biden Administration for Enabling Illegal Immigration

FRANKFORT, Ky. (June 1, 2023) – Attorney General Daniel Cameron yesterday challenged a Biden Administration border policy that would incentivize illegal immigration. In a lawsuit filed yesterday, Attorney General Cameron expressed concern that Customs and Border Patrol’s (CPB) rule would make America less safe by opening our borders to a flood of unlawful immigration.

Under the Biden Administration’s new rule, anyone in the world could make an asylum claim under a web-based app called CPB One. Once a claim is made—regardless of its merits—the individual or family would be granted entry into the United States, given work papers, and allowed to remain in the country while the claim is reviewed, a process which can take years.

“This immigration policy is a cheap regulatory trick that would make America less safe,” said Attorney General Cameron. “Criminal aliens may try to take advantage of President Biden’s weakness, but I joined this coalition to prioritize the safety of Kentuckians and the well-being of the Commonwealth over radical open border policies.”

In its lawsuit, the coalition of 18 attorneys general derided the proposed rule as “some combination of a half measure and a smoke screen,” and “part of the Biden Administration’s broader effort to obfuscate the true situation at the Southwest Border.”

Ultimately, the rule is a regulatory loophole for hundreds of thousands of aliens—potentially millions—who otherwise would cross the border illegally, the lawsuit explains. A simple lie on an app allows “vast numbers of aliens to enter the country and receive instant work authorization and quick access to public benefits,” all without any actual determination of their legal status.

These policies will “incentivize ‘an increasing number of migrants’ to use the CBP One app to make bogus asylum claims, all while avoiding the bad optics of crowds of illegal aliens ‘wait[ing] in long lines of unknown duration at the [ports of entry].’”

This is Attorney General Cameron’s latest effort to stop the Biden Administration’s out-of-touch open border policies.

Earlier this year, Attorney General Cameron opposed President Biden’s unlawful use of immigration parole power and sued the Administration over its failure to maintain the momentum created by President Trump’s sensible, America-first border policies.

Attorney General Cameron was joined by attorneys general from Alaska, Arkansas, Florida, Idaho, Indiana, Iowa, Mississippi, Missouri, Montana, New Hampshire, North Dakota, Oklahoma, South Carolina, Tennessee, Utah, Virginia, and Wyoming in filing suit.
